What to look for in each kind of contract

Use this whether or not you upload anything. If you cannot find the answer in the contract, ask before you sign.

NIL deal

  • How much, and exactly when you get paid. Net 30, net 60, or only after you post?
  • Exclusivity: can you work with any other brand in the same category?
  • Who owns the photos and videos, and for how long they can use them.
  • A morals clause: what lets them cancel and take money back.
  • Whether the deal still holds if you transfer or get hurt.

School revenue-sharing contract

  • Exit fees or buyouts if you transfer. One school sued a quarterback for $1 million.
  • Which of your NIL rights you hand to the school.
  • When payments stop: injury, transfer, discipline, leaving early.
  • Whether payments are taxed like a paycheck or paid with nothing taken out.

Agent agreement

  • The fee, and whether it comes off the full contract or only money you receive.
  • Extra marketing or management fees on top of the agent fee.
  • How long it lasts and how you get out (notice days, fees owed after you leave).
  • Who can sign for you or touch your money. The answer should be nobody.

Endorsement or marketing deal

  • Total value versus what is guaranteed.
  • How many posts, appearances or hours you owe, and what happens if you miss one.
  • Auto-renewal and cancellation terms.
  • Who pays travel and costs.

Lease, car loan or big purchase

  • The real total you will pay, not just the monthly number.
  • Whether someone is cosigning, and what that makes them owe.
  • Penalties for leaving early or paying off early.

When to use a lawyer instead

A plain-English review helps you understand a contract and know what to ask. It is not legal advice. For a pro contract, a school contract with a buyout, or any deal worth more than a few thousand dollars, have a licensed contract or sports lawyer read it too.
